What he clipped out were assertions to the effect that it is illegal in the European Union to keep records of user IP addresses, including dynamic IP addresses. The communication between the two is interstate commerce subject to federal law. Washington state law wouldn't apply. The rest of this is a bit of a digression on the Washington law. The Internet is primarily interstate. So state laws can probably be easily challenged as unconstitutional attempts to regulate interstate commerce. This one is more careful to make sure its boundaries are the state of Washington. This particular law is foolishness because it only applies to things that are already illegal: Using a third party domain name is a trademark infringement anywere in the US. There are several successful court cases on just this topic. Much spam doesn't have a misleading subject. Some does. But I'd say more than half or 3/4ths doesn't. The part that has misleading subjects aren't the major spammers. And not least, its not likely that any major provider is going to be "Washington only". Aol might have servers in Washington, but who knows what users are in Washington. The laws major effect is that spammers in Washington must include something in the subject to indicate its commercial. Big deal. Not much of an anti-spam law. The interesting thing about this particular law is the part you didn't mention. It includes a section about immunity from liability for blocking UCE. Since the only liability is Federal & criminal, and would be found in a federal court with fines payable to a federal court and jailtime served in a federal prison, I'm not sure how this would work. There is a civil liability section in the ECPA, but I didn't think a state could invalidate a judgement made by a federal court. But its certainly a new twist. It's the annoyance factor that my customers face. I already get complaints from customers just because I have not actually implemented/deployed any of the blocking facilities I speak of. I have no plans to block by content. My current plans are to block known open relays and dialup ports. The source of the report was MCI Worldcom customer service. Due to the number of mergers, it is sometimes hard to keep who has what where straight. Even the employees of the companies involved have trouble. As an outsider, I have no hope of getting everything correct. But here goes. As I understand this, the ATM problem is affecting Worldcom's original ATM backbone, which uses Stratacom ATM switches. Perhaps the reason why worldcom CSC said they were escalating the matter with Cisco is Stratacom is now owned by Cisco. MCI Worldcom CSC only told us the vendor involved was Cisco, not anything about specific equipment models affected. I believe the other ATM networks owned by MCI Worldcom, such as MCI and UUNET are still seperate and aren't directly impacted. I don't know where MFS's network was rolled into. To fix the problem, MCI Worldcom customer service reports they will have to reload all the Worldcom ATM switches this evening between Midnight and 2:00am. >This is interesting. Does Verio often reveal confidential information about their customers' customers traffic? I wonder how Verio's ISP customers/peers feel about that. I know I wouldn't be happy if UUnet or BBN thought they could capture and publish my customers packets. My customers include insurance and health care (privacy intensive) companies. They would be very unhappy if we used someone who had this attitude. The anti-spammers usually claim the abuse exception as justification for instituting a block. Its their best (though still flimsy) argument. Its flimsy since the congress has the authority to regulate or ban spam, and the congress did pass laws banning junk faxes, and limiting calls to cell phones, yet they have not yet banned spam. Nor has any court found spam by itself to be an abuse. The one spam related law that was before the congress would have placed some requirements on spammers, but would have made it specifically not an abuse for 2511. OUTAGE: MCI Worldcom nationwide ATM network

MCI Worldcom had a circuit outage in Indianapolis at about 11:30 CST 3-Feb-1999. Since then the MCI Worldcom ATM network has been FUBARed. MCI Worldcom believes the problem is in some Cisco equipment, and cisco has issued a patch. MCI Worldcom will be reloading their entire nationwide ATM network between midnight and 2:00am hoping to fix the problem.
