Wrong, wrong, wrong, Dr. Wrongy W. Wrongenstein. If you're served with notice that you have a downstream customer /conducting business that's illegal or tortious/ , you can't ignore it.. IANAL(yet), but ISPs don't really enjoy the same rights as "public carriers" s/a telcos. And in this case, ISP didnt act to protect itself under safe-harbor. They just liked the cash. They're not responsible for inspecting "tens of millions of packets per second". Where'd that come from? They _are_ responsible for ignoring FedEx'd documents containing C&Ds / notices of infringement. Some 15 violations, if you read the decision. (C07-03952JW) Jury findings: 10: "Did [Louis Vuitton] prove that [ISP] knew ... that one or more of (their) customers were using (their services) to directly infringe the copyrights of [Vuitton] and that (ISP could still provide services but not the infringing website(s))?" -YES- 12: "Did [ISP] (act in a manner that would protect them under DMCA Safe Harbor"? -NO- 13: "Did [ISP] (do this willfully)?" -YES- Your business break the law in the name of the Dollar, your business will pay. (speaking only for myself and no one else)... You make a good point Chris.. Regardless of any politician or bureaucrat's motive for taking an action, many (most?) are ill prepared to speak or even ponder the topic of "the Internet" (and the fancy series of tubes.. ) [much less make laws about it] I was in a local city council meeting recently while one of the council members was chiding a very polite Time Warner Cable "Gov't affairs" spokesperson on something the council person had obviously no clue about.. I was embarrassed for him and proud the TWC rep was able to remain professional.. I read an article on DSL Reports the other day ( http://www.dslreports.com/shownews/FCC-Please-Define-Broadband-104056) in which the FCC has a document requesting feedback on the definition of Broadband. What are your thoughts on what the definition of Broadband should be going forward? I would assume this will be the standard definition for a number of years to come. Thanks. -- :Luke Marrott

Questions for the community: from a Application Service Provider perspective - how / can one provide application access to a group of Enterprises where the ASP provider provides ASP like applications to all Enterprise customers who have multiple locations and who may or may not have overlapping addresses? Each Enterprise is it's own business and we cannot allow connectivity between each other We've struggled internally with this. MPLS and using BGP communities seems to be the solution. But I am trying to understand / think through the configuration of it from a CE and PE side perspective. Lab configs to follow but here's what I'm thinking: - From the CE side we could ask for 2 frame PVC's - each in it's own VRF on the PE side. Call 1 VRF private and 2nd VRF public. In the Private VRF advertise all CE routes between customer A for example. Each CE customer would have their own VRF on the MPLS providers network. - From the CE, In Public VRF advertise a network range we provide the clients and NAT traffic destined for the shared environment to the public range - On each CE router only permit route updates on the Public VRF for BGP communities that belong to that customer and our shared segments. Could also do this with just route filtering by ACL/prefix lists. On the Private VRF no need to filter incoming but filter outgoing to contain routing domain consistency (only send updates for CE networks) - In the Public VRF from ASP side - advertise all shared services routes. Accept all updates on Public VRF. No access to Private VRF's here. Thoughts? Thanks, Kenny

I think the big push to get the fcc to define broadband is highly based on the rus/ntia setting definitions of what broadband is. If any anyone has been fallowing the rus/ntia they are the one handing out all the stimulus infrastructure grant loan money. So there are a lot of political reasons to make the definition of broadband a bit slower than one would think. I guess it doesn't hurt that the larger lec's with the older infrastructure are shelling out the money to lobby to make sure the definition stays as low as can be. They don't want to see the gov funding there competition. The dropping of internet is done on purpose to preserve the battery for the pots when ac power is lost. This is an actual setting in just about all manufacturers of ftth equipment. You'll probably have a hard time to get them to change the profile on the equipment tho but it is possible.
