On behalf of our client, Samsung America Inc., ("Samsung") we hereby request that you cease and desist all inflammatory internet hacking, telephone hacking, flaming, jamming, and other illegal activities. If you have responded aversely to a recent bulk email message from our client, Samsung America, Inc., or from any of its subsidiary companies, then you may be one of the people who has performed fraudulent and actionable transgressions, thereby causing severe harm to our client. Your email name was provided as being suspected of connection to various acts of internet terrorism. Your acts are illegal. Several messages have suggested that Samsung and/or its subsidiaries, including but not limited to Sailahead Global Emporium, www.sailahead.com, and Samsung Electronics, www.sosimple.com, violated US Federal Laws through activities commonly called "spamming." This allegation is unfounded in the law, as spamming is a protected activity under the laws of free speech. Our client has asked us to inform you that all of your future correspondences should be directed to their counsel: Russell L. By doing so, you're helping the net.scum that is behind this forgery, who is attacking the credibility of the company and law firm. There was a story about it on CNN's web site. URL is: http://customnews.cnn.com/cnews/pna.show_story?p_art_id=220993&p_section_name=Sci-Tech Basically, the spam did not originate from Samsung nor from the legal firm, and both are working on finding and treating the guilty party to a taste of the American judicial system. *watches knees all over the world jerking in response to the forged spam* I would recommend against a knee-jerk reaction. :) And so endeth my two bits here. -Dan Foster Internet: dsf@frontiernet.net

If this is for real, I'd love to see Mr. Allyn's response if his AOL address were subscribed to thousands of bulk email lists. How much would spamming be protected as free speech then? Not that I'd advocate doing such. -Jon On Mon, 11 Aug 97 12:53:38 -0700, jon@clearink.com writes:

Doesn't sound like something an intelligent attorney would pen. Even if he has a point (not to be confused with a case), I would think any legitimate and properly-educated attorney understands the First Amendment well enough to know that a) it doesn't even seem to apply to states (except as via the Fourteenth Amendment), b) it certainly doesn't apply to individual business entities not connected with the government, and c) in no case does the First Amendment justify theft of services and other resources.
