I read this as a requirement that NSI not lock any alternative registrars out, nor can they use the registry (or it's database) for unfair advantage.
I had a discussion about this with Ira Magaziner, and he assured me that NSIs registry would have to be divested of the registrar functions under this agreement. I think the phrase " ... assests of the registry not be utilized ... " addresses your concern (and mine.)
