I'm no lawyer, but it seems silly that you'd be liable for stuff you weren't even aware of (or perhaps that you had told them not to do but they did anyway, who knows).
I am also not a lawyer, but I'd think that turning around and immediately suing the marketing company that's ruining your good name will probably go a long way in convincing your ISP and/or any legal authorities that you didn't approve of the spamming.
